Terms and conditions

1. Acceptance of the Terms By accessing or using the FCX platform (the "Platform"), you agree to the Terms and Conditions described in this document. If you do not agree with any of these terms, you must immediately stop using the Platform. Continued use after any change implies acceptance of the new conditions. 2. About FCX FCX is a socio-behavioral commercial intelligence platform developed and operated by FCX Solutions Inteligência de Negócios Ltda., registered under Brazilian company registry (CNPJ) No. 54.288.721/0001-78, headquartered in the city of São Paulo, State of São Paulo, Brazil. The Platform provides admissible behavioral profile analysis, territorial expansion mapping, active discovery of candidates and prioritization of commercial opportunities, through the Guided Analysis module, coordinated by the agentic AI ATTO, and its four internal engines (Up-sell and Cross-sell, Persona, Opportunities and Leads). The services are strictly informative in nature and support commercial prioritization; under no circumstances do they constitute credit risk assessment, default scoring or credit bureau activity. 3. Registration and Account Security To use FCX, you must create an account linked to an active CNPJ and provide accurate and complete information. You are responsible for keeping your access credentials confidential and for all activities carried out in your account. Credentials may not be shared with unauthorized third parties. Notify us immediately of any unauthorized use of your account at suporte@fcxsolutions.com.br. 4. Plans and Access Access to the Platform depends on the contracted plan, which defines the Monthly Allowance of credits available: — Free: BRL 0.00/month, with 1 (one) simple Guided Analysis of 1 (one) product per month. — Pro: BRL 3,995.00/month, with 500 monthly credits, access to ATTO's four engines, complete reports and the connectors and integrations made available for the plan. — Max: BRL 7,990.00/month, with 1,000 monthly credits, access to ATTO's four engines, complete reports, the connectors and integrations made available for the plan, greater operational capacity, processing priority and priority support. The Monthly Allowance is not cumulative: unused credits are not carried over to the following cycle. Once the allowance is exhausted, users on the Pro and Max plans may purchase pre-paid Extra Credits at BRL 10.00 per credit, charged immediately to the card on file. Extra Credits purchased do not expire. Users on the Free plan may not purchase Extra Credits. The full conditions are set out in the Licence of Use (EULA). 5. Privacy and Data FCX values your privacy and processes personal data in accordance with Brazilian Law No. 13,709/2018 (LGPD). Data use is detailed in our Privacy Policy, which forms an integral part of these Terms. By accepting these terms, you also accept our Privacy Policy. 6. Acceptable Use You agree to use the Platform only for lawful, internal business purposes. The following are expressly prohibited: — Using the Platform as a credit granting tool, for default assessment or for any purpose associated with credit bureau activity; — Selling, assigning or making the results of the analyses available to third parties not linked to your internal operation; — Copying, modifying, decompiling, reverse engineering or creating derivative works from the Platform; — Sharing access credentials with unauthorized third parties; — Using the Platform for any illegal purpose, including violation of the LGPD, money laundering or fraud; — Interfering with the operation of the Platform or with FCX servers. 7. Intellectual Property All Platform content — including software, algorithms, analytical models, reports and other technological components — is the exclusive property of FCX Solutions Inteligência de Negócios Ltda., protected by the applicable legislation on copyright, industrial property and trade secrets. The user receives only a limited, non-exclusive and non-transferable licence to use it, for the duration of the active subscription. 8. Limitation of Liability FCX does not guarantee specific commercial results. The reports, signals and recommendations generated by the Platform are decision-support instruments, and the commercial decisions made on their basis are the sole responsibility of the user. FCX shall not be liable for indirect damages, loss of profits, loss of revenue or loss of commercial opportunities, except in cases of proven wilful misconduct. 9. Changes to the Terms and Services We may modify these Terms and Conditions at any time, with at least 15 days' prior notice, by publishing the new version on the Platform. For changes affecting privacy clauses, data use or limitation of liability, explicit acceptance will be required before access continues. For all other changes, continued use after the notice period implies tacit acceptance. 10. Termination We may suspend or terminate your access to the Platform at any time, with prior notice, in the event of a breach of these Terms or for security reasons. During the first 90 days of the agreement, termination without cause is not permitted. After that period, the agreement may be terminated by written notice given at least 30 days in advance. 11. Refund Policy Plans are billed monthly and the monthly fee is not refundable in proportion to usage. Unused Monthly Allowance Credits and Extra Credits are not converted into a financial refund, save for the right of withdrawal set out in the Licence of Use (EULA) and rights that cannot legally be waived. If you have any questions, contact us at suporte@fcxsolutions.com.br. 12. Governing Law and Jurisdiction These Terms and Conditions are governed by the laws of the Federative Republic of Brazil. Before filing any claim, the parties undertake to seek a consensual solution within 30 days. The courts of the District of São Paulo, State of São Paulo, are elected, with express waiver of any other. 13.
